Five Figure Sum For A Delayed Diagnosis Of An Ankle Fracture

Nelsons represented Ms X in a claim against Nottingham University Hospitals NHS Trust after an ankle fracture was negligently diagnosed as a sprain.

Ms X twisted her ankle whilst walking across a muddy field in November 2014. She attended the Queen’s Medical Centre the same day but was advised that she had suffered a sprain and was discharged.

The pain continued and in February 2015 she attended her GP practice. The original x-ray was reviewed and a fracture could be seen. She then had to undergo surgery.

The Trust admitted that they failed to review the x-ray within 5 days as per their policy and that when the x-ray was reviewed in December 2014 they failed to contact Ms X. The Trust further admitted that but for the delay Ms X would not have required surgery.
